The Consumer Product Safety Improvement Act (CPSIA), enacted in the United States on August 14, 2008, introduced significant safety regulations for children’s products. Among the key provisions, products manufactured after November 12, 2008, require a “Conformity Certificate” provided to the Consumer Product Safety Commission (CPSC), as well as to distributors and retailers, confirming that the items comply with all applicable safety standards, bans, rules, and regulations for children’s products. In addition, certain products must include a cautionary statement in specific advertisements. For internet ads, this requirement became effective on December 12, 2008, while catalog and print advertisements were required to comply starting February 12, 2009.
From February 12, 2009, onward, all new children’s products must undergo testing by an independent laboratory accredited by the CPSC to ensure compliance with safety regulations. The law also bans products containing lead or phthalates beyond defined concentration limits. Furthermore, beginning August 14, 2009, stricter lead content regulations were implemented, prohibiting any paint or surface coating on children’s products that contains more than 90 parts per million of lead. Additionally, tracking labels are required to be permanently attached to each product to ensure traceability and accountability throughout the supply chain.
